The recent lawsuits, which accused the NAR and some of the country's largest brokerages of conspiring to keep agents' commissions unfairly high, could signal the start of a new era. If sellers aren't paying out commissions to buyers' agents, buyers themselves could end up on the hook. For example, what happens if the seller isn't willing to pay the buyer's agent's commission? Despite the potentially earthshaking consequences, most local real-estate agents — who, to be fair, have more pressing short-term concerns — have largely ignored the cases. "They not only have to pay a buyer's agent commission, but they can't negotiate that commission," Brobeck said of sellers. "It just doesn't make any sense for the seller to have to pay the buyer's agent," Brobeck told me.
